This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011, that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of RecruitIntell Application.

The Application RecruitIntell is owned by Mr. Karthik P Gadag.

The Terms of Use given herein describe the rules for users of RecruitIntell Application. These Terms of Use shall take effect from 1st June, 2023. If you continue to browse and use this Application, you agree to abide and be bound by the following terms of use. If you do not agree to abide by these terms of use, do not use this Application in any manner. These Terms of Use (‘TOU’) constitute an electronic record within the meaning of the applicable law. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Content Liability
The Application and the content are provided to you “AS IS” and the entire risk as to the quality and performance of them is with you. RecruitIntell reserves the right, at its discretion, without notice to you, to change, modify, add or remove portions of these TOU at any time by updating this posting. It is your responsibility to familiarize yourself with the TOU regularly to ensure that you are aware of any changes. If you continue to use the Sites after we post changes to these TOU, you are signifying your acceptance of the new terms. To the fullest extent permitted by applicable law, RecruitIntell expressly disclaims all warranties and representations of any kind, whether express, implied, statutory, or other, with respect to the Application and its content (including, but not limited to, any implied or statutory warranties of merchantability, fitness for a particular use or purpose, title, and non-infringement of intellectual property rights). Without limiting the generality of the foregoing, we make no warranty that the Application and the content will meet your expectations and requirements or that their operation will be uninterrupted, timely, secure, or error free or that any defects will be corrected.

You acknowledge and agree that when you provide us with content, or view content provided by others, you are doing so at your own discretion and risk. The views expressed by users in this Application do not necessarily reflect the views of RecruitIntell, and we do not support or endorse any user content. RecruitIntell does not promise that the use of the Application or its content will provide specific results. RecruitIntell does not make any warranty as to the accuracy or reliability of any information obtained through the Application and the content. You assume all risk and responsibility for any loss or damage whatsoever to your system, data and business arising out of your use of the Application and the content. Your sole remedy against RecruitIntell for dissatisfaction with the Application and/or any content is to stop using the Application or any such content. Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

Application User Eligibility
Our services or products may only be availed by individuals, companies, firms or any other entities who can form legally binding contracts under Indian Contract Act, 1872. Hence, users disqualified from entering into a legally binding contracts including a minor i.e person below the age of 18 years shall not use this Application.

User Representation
In using this Application, you agree:

  • Not to cause damage to this Application and/or the content or impair the availability and accessibility of this Application and/or content;
  • Not to disrupt or interfere with the security of this application or abuse any services, system resources, accounts, servers or networks connected to or accessible through this Application or affiliated or linked websites;
  • Not to violate any intellectual property right or any other proprietary right;
  • Not to disrupt or interfere with the enjoyment of this Application or affiliated or linked websites by a user;
  • Not to upload, post or transmit through this Application any harmful, disruptive or destructive files;
  • Not to transmit through or on RecruitIntell, any spam, chain letters, junk mail or other unsolicited mass mail to people or entities who have not agreed to be part of such mailings;
  • Not to obtain or attempt to obtain unauthorized access to this Application or parts of it which are restricted from general access;
  • Not to use or attempt to use another’s account, service or system without authorization from RecruitIntell;

Intellectual Property
All legal rights, titles and interests in and to the Application and the content, including, without limitation, trademarks, service marks, design marks, patents, copyrights, database rights, and all other intellectual property appearing on or contained within the Application, whether registered or unregistered, are owned by RecruitIntell and our licensors or partners. This Application and its contents are protected by applicable laws including but not limited to Copyright Act, 1957 and Trade Marks Act, 1999. Reproduction, copying, modifying, republishing, adapting, transfer, distribution or storage of all or any part of the contents of this Application in any form without authorization of RecruitIntell is prohibited.

Application Use
RecruitIntell shall provide each customer with a username and password to be used to log into its account. These credentials must not be used by multiple persons. You are solely responsible for maintaining your access credentials secure and confidential and you are solely liable for any and all activity that occurs under your access credentials. You agree to notify RecruitIntell immediately of any unauthorized use of your access credentials.

Our services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. To ensure optimal utilization of our services, the user shall be required to submit certain job-related information including resume, date of birth, email id, mobile number, address, location, hiring company’s details and CTC /compensation details of candidates. When you share your personal information through the Application and/or the content then you consent to our maintaining, recording, holding and using such personal information in accordance with the privacy policy required by law.

If you submit feedback or suggestions about our Services, we may use your feedback or suggestions on our Application without any obligation to you.

Customer Data
By uploading customer data, you authorize RecruitIntell to process the customer data. The customer and any of the users associated with the account shall not create, upload, transmit, display or make otherwise available any customer data that violates the terms of these TOU or any applicable laws or regulations, the rights of RecruitIntell, other customers or users, persons or organizations or is harmful, offensive, threatening, abusive, libellous, harassing, tortuous, defamatory, vulgar, obscene, invasive of another’s privacy, hateful or otherwise unlawful RecruitIntell is not obliged to pre-screen, monitor or filter any customer data in order to discover any unlawful nature of such data. However, in the event, if such unlawful data is notified to or discovered by RecruitIntell, we may take the following actions:

  • To notify the customer of such unlawful data;
  • Deny its publication in the application;
  • Demand the customer publishing such unlawful customer data to comply with these Terms and Conditions and applicable law;
  • Temporarily or permanently remove such unlawful data from the Application or restrict the access or delete it with or without notice.

Cookies​
RecruitIntell uses cookies to distinguish you from other users. This helps us to provide you with a good experience when you browse our Application and also allows us to improve our Application. By continuing to browse our Application, you are agreeing to our use of cookies.​ A cookie is a small text file of letters and numbers that we store on your browser or the hard drive of your computer if you agree. Cookies contain information that is transferred to your computer’s hard drive.​ You can block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block cookies you may not be able to access all or parts of our Application.

Third Party links
For the easy accessibility of the user, RecruitIntell may include links to other websites on the internet that are owned or operated by third parties to which these terms of use shall not apply. RecruitIntell is not responsible or has any control over the content of such third-party websites. A summary or link to third-party website does not imply that RecruitIntell endorses such website or the products or services, or warrants the accuracy of the content displayed in such websites. No responsibility or liability shall be assumed to RecruitIntell for any material created or published by third party websites or for any damage or injury arising from the ability or inability of the user to access such websites.

Cancellation and Refund
We expect our customers to purchase our services after careful consideration and evaluation of our platform. As such requests for cancellation and refunds are not entertained. Customers will not be entitled to refund in cases including, when they do not qualify for the job posting, job advertisement is not posted and funds were deposited for job advertisement purposes. In case of an extraordinary situation, please write to us and we would give due consideration in such a case.

Limitation of Liability
To the fullest extent permitted by applicable law, under no circumstances shall RecruitIntell be liable for any direct, indirect, incidental, special, exemplary or consequential damages of any type whatsoever related to or arising from your access to, or use of, the Application and/or any Content, including, without limitation, any loss of profits, business interruption, lost savings or loss of programs or other data, even if RecruitIntell authorized representative had previously been advised of, or reasonably could have foreseen, the possibility of such damages, however they arise, whether in breach of contract, negligence or other tortuous action.

You agree to defend, indemnify, and hold RecruitIntell and any of its directors, employees, agents and contractors harmless from and against any and all liabilities, claims, losses, costs (including without limitation reasonable attorney’s fees) or other expenses that arise directly or indirectly out of or from (i) your breach of the TOU; and/or (ii) your use or misuse of the Application and/or Content.

Severability
In case, any provision in these terms of use is or become partially void, the users will continue to be bound by remainder of the provisions and such void provision shall be deemed severable from the remaining provisions.

Applicable Law
These terms of use shall be governed by the laws of the India. Any claims or disputes arising out of these terms of use shall be determined by courts of Bengaluru. You agree to submit to the personal jurisdiction of the Courts of Bengaluru for the purpose of litigating all such claims or disputes. Notwithstanding the same, we reserve the right to seek injunctive or other equitable relief to protect our intellectual property in any court of competent jurisdiction.
